The only clarification I would make over Knnmbd's interpretation is that as long as you have a US master's degree or higher, the "3 years work experience in a related field" restriction will not apply. If you read section 201 carefully, you will see that the difference between items 1 and 2 is that item 1 refers to US advanced degree holders while item 2 refers to advanced degree holders (resumably non-US educated). The 3 year restriction only applies to those who fall into item #2.
So, if
a) you have a MS from a US university, you and your immediate family (spouse and minor children) will not be subject to the 3 years restriction and will be exempt from the Visa Cap
b) you have a masters or higher from an acredited non-US university, then the Visa Cap will not apply to you and your family, but you shouldd have worked in the US in a "related" field for 3 years.
My question to everyone:
Will folks in section 201 be required to get a Labor certification? If not, then this will provide relief to a lot of us stuck in the BECs.
Knowledgeable folks, please comment.
REMINDER: Any such bill is still MANY months away from seeing the light of day, if at all. BUT, favorable bills such as these give us hope.

But in the larger context of things, who really cares if with a U.S M.S degree you need to just go through PERM and then you are all set without the hassle( or should I say torture) of the retrogression. thanks for responding...any contradicting/second opinions? What is the exemption towards - both filing for 485 and processing of 485 too, right? Isn't it an exemption from the EB quota?
The exemption is just to file, the processing will however take what ever the regular processing time would at that point of time. I am sure that there is no provision to expedite the "processing" of I145.

USCIS should seperate North Indians and South Indians - We are soooo very different anyways ..... Different language - different look - different food ..... That way all of us North Indians will get our GC sooner :D

A lot of people can give you advice but I think it really comes down to making peace with yourself.
I have been thru the pain of being stuck in LC for over 4 years and I can completely sympathize with you. I know it can be really frustrating. I have been thru swings of optimisim and pessimism in those 4 years. Ultimately this is what I have realized, there is always a price to be paid in life if you want to achieve anything in life. It is upto each one of us to decide if GC is worth the various years of being stuck in same job, wife being stuck on H4 is the right price for GC or am I paying too much. For me personally, I think I am paying a big price but I am like a businessman who has invested so much money and time in his enterprise that he's afraid to drop the venture and start another business. Actually a lot of us fall in this category.
So look at it this way. Write down the price you are paying. Figure out if you still want to put your effort (and how much) in trying to get a GC. If you think its a venture that's not worth the outcome, there's your answer! If you think its worth the outcome but you are afraid you still may not get a GC, work on backup plan i.e. evaluate and apply for immigration to other western countries or evaluate and work on a plan to go back to your home country. Knowing the price and having alternate plans will give you peace of minds. More than anything else don't forget to have fun. A lot of times we get caught up in worrying about what might/might not happen in future and don't enjoy the present! Go out with your wife and have a fancy dinner every now and then ... do something spontaneous... Watch movies, listen to music, go bowling with friends ... whatever takes your mind off the routine!
I see a lot of guys telling everyone who is frustrated saying: Let your wife get her own H1, why don't you buy a house on H1, why don't you have kids? Well, its good to offer suggestions but don't get condescending. Not everyone is fortunate enough to have a stable job that they can buy a house. Not everyone's wife is in IT and can get a desi co. to sponsor H1. Not everyone is at peace mentally enough that they can plan children.
Well, I am TOO depressed about the BEC performance. I know too many people are in same situation but I find myself "helpless" and at least i want to SCREAM......:mad:

I think the major bone of contention among the legislators is what to do about the illegal immigrants currently in the country. Amnesty OR no amnsesty is the major debate. Other than that both are in a common frame of mind (in some way) one way or the other regarding - border enforcement, legal immigration, retrogression relief. Now, it looks like there is a common agreement that the skillful legal immigration issue has to be separated from the illgegal immigration related Amnesty OR no Amnesty debate. Hopefully we should see something positive in the next few months. This article seems to indicate in that direction since they have agreed upon one more item, border enforcement -

All my checks got cashed today. I applied on July 23rd at NSC and got the receipt #'s from WAC.
I hope who ever is waiting for RN's they will get soon.

Congrats!!. Good to know that TSC started processing for July NSC --> TSC transfer cases. Hope in next 2 weeks they will finish July 2nd NSC --> TSC transfer cases.
My checks got encashed this friday. Applications were delivered to NSC on July 2nd, later forwarded to TSC. My I140 was approved in TSC.
When the checks get encashed, the receipts number are printed on the back of the check. Using the receipt number you can track your application. I also subscribed for automated email from the USCIS website if there is any change in the status. I got an automated reply from USCIS yesterday.
Application Type: I765, APPLICATION FOR EMPLOYMENT AUTHORIZATION
Current Status: Card production ordered.

Just reading this thread, so not sure if I can attend today.
Will surely attend the rally with my wife on July14th.
Just a thought..Why not request all our GC/citizen friends to also attend?
I will persuade all my friends to attend.
If not anything, they can see it as a nice stroll in the downtown.

If you have h4 stamp in your passport , you can go out of the country and comeback in and you would be back in h4 status. Short of that I don't see any other option. Ohers please chip in with your ideas.
Once your new status is approved you cannot go back to any prior status. Even if you have an unexpired H4 visa stamp in your passport, it becomes invalid. You would have to get the passport stamped again at the US Consulate.

I apologize if the post sounded discouraging / instigating to members. I do completely support IV team, particularly because it is a collective decision made by a dedicated group which certainly would be much more wise than what I think with my limited awareness on this whole issue. Yes indeed as somebody pointed out--if the backlog is removed completely there would not be a need for H1b 3 year renewal.

If you really wanted to correct the so called misinformation I am spreading why do you have to start with things like "IV member know that you don't want to volunteer"? Is this is supposed to intimidate me or you just trying to spin information for your own cause?
Please understand that I am not against what IV stands for and what the members do. What I don't agree with is the way some immature Senior members do by loosing their cool. Cutting off peoples thoughts and ideas in not right. I would go futher to make a bold suggestion, " IV has to screen these so called senior members for maturity before making them members who carry the message"
I am not blaming anyone here, but moderation in their temper is expected off the senior members in any place not just in this forum. Intimedation and threats have always resulted in the downfall of the whole group, history would teach us that.

going back to india is a personal decision, and each case differs. circumstances are key in this decision process. one or more members' past experience in india will not apply...
for the people who decided to go, if you want to share your decision, please do and may be post on your experience once you have reached and settled in india.
