My lawyer is taking his own sweet time to apply. It is frustrating. Do you guys think that there is any chance that they will stop taking 485 applications at some point before 30 june? Please reply...we are worried.

i do not understand the fuss about it. why do we over react to it. Big law firms like FDBL ( fragmon) all said the lawsuit is not winnable no chance , DOS can change VB any time as per federal law. whats the use of all this??

I personally think GC quota has a rationale behind it. It allows for a reasonable share to go to smaller countries so that the US population maintains its diversity. Besides, near the end of the year, if the numbers are unused, they are rolled over to larger countries like India and China, thereby automatically eliminating the quota.
If the original intend was to promote diversity (whether it is in FB or EB immigration), quota should be based on ethnicity of US population ( GC holders and citizens ). Ceiling should be applicable to countries those have a high percentage of representation in US population. Does India or China constitute a majority in US population ? No way. Indians and Chinese are a minority in US population.
The concept of "diversity" by country is a racially motivated law. It does not promote diversity. In fact it limits diversity.

It has become fashionable for employers of all types and sizes to require their employees to sign non-compete agreements. These agreements range from very narrow to very broad in scope. A non-compete may bar you from working for a competitor, using or disclosing trade secrets or other confidential information, soliciting customers or recruiting the your employer�s customers. These restrictions generally last from a few months to a few years. Because signing such an agreement can severely restrict your future employment options, you (and your attorney) should review it closely before doing so.
Can you be fired for refusing to sign that non-compete agreement?
Yes, according to the Supreme Court of New Jersey. See Maw v. Advanced Clinical Communications, 179 N.J. 439 (2004).
Will a New Jersey court enforce your non-compete agreement?
Do not make the mistake of thinking that you can sign an agreement and ignore it later. New Jersey Courts routinely enforce non-compete agreements that are �reasonable� in scope. A non-compete agreement will generally be considered reasonable if it (1) protects the legitimate interests of the employer; (2) does not impose an undue hardship on the employee; and (3) is not injurious to the public.
What will happen if you have signed a non-compete agreement that is not �reasonable�?
If the geographic and temporal restrictions in your non-compete agreement exceed the boundaries necessary to protect your employer, a New Jersey court may modify the agreement by reducing those restrictions to make the agreement reasonable. See Solari Industries v. Malady, 55 N.J. 571 (1970).

As per him, every non-compete agreement that is signed cannot be neccessarily enforced in the court of law. If the sole purpose is to avoid ordinary competition, it is unreasonable and unenforceable. If the agreement is ever challenged in court, the most important question, which will be posed from the Judge to the employer, is "What is the legitimate business purpose that is served by this non-compete agreement?"
Now as h1b employees, as every one knows we r not the key personnel in the company. we do not carry with us any trade secrets or confidential information which might harm their business.
AS per him the higher up the "food chain" an employee is at a company, the more willing courts are to enforce non-compete agreements. Upper level employees are typically exposed to more confidential, trade secret, strategic and other information that gives a company a competitive advantage in the market place. The lower down the food chain an employee is, the less likely a court is to enforce non-compete and non-solicitation terms.
Also non competes always have to give some profits to the employee, say a paid vacation, bonus or somethign like that. An employer cannot
just make the employee sign it to restrict him from making better living and not give anything in return....
Seems like these things are favourable to all the h1b employees.

How many such cases are with uscis? And what happens to the one you filed for yourself?
During July 07, i know some of the couples did apply twice once a primary and other as dependent on the other. In July 07, wife and i did not take that approach and had separate applications. In August 08, i applied for my second 485 as her dependent since i would have to wait a decade to get gc through my application. For now, my other application shows under review. Once i get GC in my hands, then i will ask my compnay lawyer if there is a need for withdrawing my other application.

I do not think transfer matters. Mine was filed directly with TSC because my lawyers reason: my I-140 was approved from there.

I am guessing that we will probably receive similar response as posted by sweet_jungle that they are waiting for local ASC. I don't think we will receive FP after notice 30 days but this kind of response. Maybe local ASC are scheduling peoples appointment based on their name check results. Otherwise why would people who applied on last day of filing , Aug 16,2007 receive FP notice from my local ASC and not me.
Apahilaj, I have this idea. Is there a way we can reach an IO who is not associated with TSC but can give the same information. Maybe an IO of NSC/CSC.

I dont have a problem signing 1 yr agreement because my 140 will take at least another 8 months ( Feb 08) and by the time next years budget opens up for good new Jobs its already Mar 08.

4. Showed how illegals are being rewarded for breaking the laws, and how the legals are being punished by current bill.
Guys, it may take a while, but do e-mails and faxes. The hardest fax to reach was sen. Reid's office.

My checks got cleared at TSC today.
Previously
My 140 was approved at TSC, sent 485 to Nebraska on June 22, they received on June 25. I called to check status yesterday, the lady said to wait. On asking if case will be transferred to TSC and if TSC will generate receipts, she said she doesn't know, but it may take at least 2-3 weeks to process receipts at Nebraska.

2) Any talk about illegal 'rights' and 'plight' is irrelevant to our discussion
3) Getting defensive about illegals or being offensive to any ethnic community is a sharp deviation from our proposed objectives at IV
4) If we do not have anything constructive to contribute while CIR dies, we should rather have constructive decisions about legal immigration bills or topics
5) Lets stay united and fight it out even though the chips may be down right now.
